Terms of service
The Terms and Conditions of Sale apply to all products ordered from Marine Fiberglass Direct.
Orders
To facilitate filling your order, please be as specific as possible. Orders must specify product number, quantity desired, and any descriptive information (e.g. size or color). Every effort will be made to fulfill all orders; however, we cannot guarantee the availability of any particular product displayed in our catalog.
Back Orders
We strive to keep backorders to a minimum, but occasionally we may be temporarily out of an item. Items that are out of stock at the time your order is processed will be backordered. Marine Fiberglass Direct will do its best to inform you of any delays that it is made aware of, but will not be held liable for late delivery, missed shipments, installation delays, or other related deadlines out of its control.
Special Orders and Custom Fabrication
Please let us know if there is something you need that is not listed in our catalog. We can often special order or fabricate those items for you. Special orders and custom fabricated products are non-returnable and non-refundable. Custom fabricated products are manufactured to tolerances of 1/4" on dimensions and 5 degrees on angles; variation within these tolerances is not considered a defect.
Prices
Current pricing for all of the available products in our catalog can be found on our website at www.marinefiberglassdirect.com. Prices are FOB shipping point and do not include freight, applicable federal, state or local taxes, customs duties, brokerage fees, or export packing charges. Prices, specifications and availability of items are subject to change without notice. Suppliers and manufacturers may increase a product price, which will be passed on to the consumer; the consumer will be notified promptly if this occurs.
Volume Discounts
Please contact us when you need large quantities of an item. We may be able to offer you special, discounted volume pricing based on the quantity required.
Payments and Terms
We accept Visa, MasterCard, Discover, American Express, PayPal, wire transfers, money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. All payment accounts, with the exception of wire transfers, must be issued by a US bank or financial institution and must have a billing address in the US. Payments can only be processed if the billing information can be verified. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. All returned checks (paper or electronic) are subject to a service fee of $35.00 or 5% of the face amount of the check, whichever is greater. We reserve the right to exclude or limit certain payment methods at any time.
Special volume priced quotes may be limited to certain payment methods.
Unless satisfactory credit terms are established in advance by execution of a separate credit agreement, payment for goods is required at the time of ordering. Marine Fiberglass Direct reserves the right to charge a finance charge up to 1.5% per month (18% annually) of any order which remains unpaid after the invoice date. Customer agrees to reimburse Marine Fiberglass Direct for reasonable attorneys’ fees and any other costs associated with collecting delinquent payments.
Sales Tax Policy
The amount of tax charged on your order will depend upon many factors including the type of item purchased and destination of the shipment. Factors can change between the time you place an order and the order is delivered, which could affect the calculation of sales tax. The amount appearing on your order as Estimated Tax may differ from the sales taxes ultimately charged. Where required, tax will also be applied to the shipping and handling charges. Depending on the tax laws in your state, you may be required to pay use tax on purchases for which we do not collect sales tax. If your order is tax exempt, please send us a copy of your current sales tax exemption certificate by email to info@marinefiberglassdirect.com.
Shipments
Unless you specify otherwise, we will ship your order in the most efficient way possible. If you have a preference of carrier, please tell us; we’ll honor your request if practicable. Smaller packages weighing less than 50 pounds are usually shipped via a parcel service such as FedEx or UPS, with charges prepaid and added to your invoice. Larger items are shipped via freight truck, with charges prepaid and added to your invoice. For freight truck orders, a shipping acknowledgement and verification form will be e-mailed and must be completed prior to shipment of your order. If you need your order rushed, please ask our representatives for a quote on expedited next-day or second-day air service.
Claims for Shortages or Damaged Goods
On a rare occasion, a package may be lost or damaged in transit. For your protection, you should always carefully inspect any shipment before accepting delivery. If damage has occurred, you must note it on the delivery receipt. If a freight truck shipment is damaged, you must also immediately have the shipment inspected by the carrier. Obtain an inspection report from the carrier, and forward a copy to us. All claims must be filed within 7 days of receipt of shipment. Returns
At Marine Fiberglass Direct, we want you to be satisfied with your purchase. The vast majority of our products are eligible for return or exchange within 30 days of purchase provided they are unopened and unused; however, some products are not eligible for return. Products that cannot be returned or exchanged include custom fabricated items, special orders, orders that received special volume pricing, products purchased under the Local Pick-Up option, and any product with a restricted return policy noted in its product description.
If the products you purchased are eligible for return: 1. Call your Marine Fiberglass Direct representative at (561) 320-1981 or 1.813.677.4000, and request an exchange, credit, or refund. 2. Your representative will issue a Return Merchandise Authorization (RMA) number – just include it with your package when you return it. We highly recommend that you use a shipping system that can track your shipment such as UPS or FedEx. If your order was sent to you via freight truck, then it will likely need to be returned via freight truck. All returns must be returned to Marine Fiberglass Direct freight PREPAID. Marine Fiberglass Direct is not responsible for freight charges on merchandise being returned for exchange, credit, or refund. 3. Exchanges, credits and refunds are typically processed within 5-10 business days following the receipt and inspection of your return. Refunds will be made using the same method and to the same credit card used on the original order. Please note all merchandise returned NON-DEFECTIVE will be charged a 15% restocking fee. Refunds are calculated based on the purchase price of the merchandise only. All shipping and handling fees are non-refundable. Merchandise returned damaged (cosmetically or otherwise) is subject to an additional fee on a case-by-case basis (please call for details). Items showing obvious signs of use are not eligible for return. Items returned with missing parts and/or accessories will be charged accordingly.
Note: Shipping costs for returns may be higher than the original shipment costs. The customer is responsible for ensuring the merchandise arrives at Marine Fiberglass Direct in the same condition as when received. For our complete returns policy, please see our Refund Policy.
Cancellation Policy
If you would like to cancel or change an order, you must contact us within 2 hours from the time the order was placed. We apologize, but orders placed online or over the phone begin processing immediately to ensure timely order fulfillment and shipping time. Our representatives will request a cancellation of your order at our warehouse. If successful, they will send you an email and the cancellation will be free of charge. If cancellation was not possible, the products will be delivered to you, which you will need to refuse upon receipt. The products will be returned to us and we will issue a refund for the merchandise only (including applicable tax); shipping and handling will not be refunded.
Export / International Orders
All international shipments must be prepaid in U.S. currency via bank wire transfer. Any applicable duties, taxes, and customs charges are the responsibility of the customer. Marine Fiberglass Direct will not understate the value of an invoice in order to reduce duties or taxes. It is the sole responsibility of the Client to select and work with a qualified freight forwarder in the continental United States who can assist Client with all import/export documentation and formalities in order to comply with customs regulations. Marine Fiberglass Direct will provide the Freight Forwarder with a commercial invoice only. All Goods are assumed delivered in good condition upon delivery to such Freight Forwarder, unless Marine Fiberglass Direct is notified within five (5) business days of delivery to Freight Forwarder. No returns will be accepted after this time.
Product Changes
Products are continually undergoing refinement in design and manufacture. Marine Fiberglass Direct reserves the right to discontinue the sale of any product and to change pricing, terms, specifications, and warranties at any time without notice.
Product Use
Buyer is responsible for evaluating whether a product is appropriate for a particular use or application. The conditions of evaluation, selection, and use of a product can vary widely and affect the use and application of a product. Because many of these conditions are uniquely within the buyer’s knowledge and control, it is essential that buyer evaluate whether the product is suitable and appropriate for a particular use or application.
All products sold by Marine Fiberglass Direct are intended to be installed by licensed and insured professionals. Installation or use of any product sold by Marine Fiberglass Direct on a boat, dock, pool, motor vehicle, motorcycle, hot tub or in any other location is at your own risk. No product sold by Marine Fiberglass Direct is to be used as safety equipment, including all cushions and related products.
Order Acceptance
Marine Fiberglass Direct reserves the right to cancel any order prior to delivery, at Marine Fiberglass Direct’s sole discretion, whether or not payment was made. If payment was made and your order is cancelled, we will issue an appropriate credit to your account, or may contact you to collect information in order to do so.
Color Accuracy
We have done our best to display the colors of the products as accurately as possible on our website. However, due to display and printing limitations, we will not be held liable for variations in color. Gelcoat and finished fiberglass products in particular may vary slightly in shade between production runs. If the color of a specific product is extremely important to you, please contact us and ask if a sample is available before placing your order.
Misprints/Typographical Errors
At Marine Fiberglass Direct, we strive to ensure our catalogs and website are accurate, but occasionally errors do occur. Marine Fiberglass Direct will not be held responsible for errors.
Local Standards and Regulations
Certain products sold by Marine Fiberglass Direct are designed to satisfy state and federal requirements. Because local standards and regulations may vary significantly, Marine Fiberglass Direct cannot guarantee products meet all applicable requirements in each locale. The purchaser assumes responsibility for compliance with local standards, codes, and regulations where the products will be shipped, sold and used.
Warranties
Many products sold by Marine Fiberglass Direct are covered against defects by manufacturers’ warranties. A copy of each manufacturer’s warranty is available upon request. If you experience any product defects inside of our return period or have any questions, please call us at (561) 320-1981 or 1.813.677.4000. If failure of a product purchased through us occurs during the manufacturer’s warranty period, a claim for adjustment may be submitted directly to the manufacturer, or our company will assist on submitting such claims. Products sent to us for warranty consideration are accepted only under the conditions stated in the manufacturers’ policies. Please note acceptance of such items by us for submission to the manufacturer does not imply validity to any claim. All decisions regarding the repair or replacement of any items are the sole responsibility of the manufacturer. Under no circumstances are we as a distributor authorized to replace a defective item prior to submitting such item to the manufacturer.
Disclaimer of Warranties
Marine Fiberglass Direct disclaims all warranties either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose with respect to any product purchased from any Marine Fiberglass Direct retail store, website, or catalog. Marine Fiberglass Direct’s liability in connection with a customer’s purchase is expressly limited to Marine Fiberglass Direct’s return policy set forth above, and all claims for consequential, incidental, or special damages are hereby excluded.
Indemnity
Neither Marine Fiberglass Direct, nor W.R. Williams Enterprises, Inc. shall be subject to, and each disclaims: (1) any obligations or liabilities arising out of breach of contract or of warranty, (2) any obligations whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by Marine Fiberglass Direct, or any undertakings, acts, or omissions relating thereto, and (3) all consequential, incidental, or contingent damages whatsoever including, but not limited to, labor costs or loss of profits arising out of or in conjunction with the manufacture, sale, delivery, use of, or inability to use any products purchased from Marine Fiberglass Direct.
Loss or Theft After Delivery
Marine Fiberglass Direct is not responsible for packages stolen from a ship-to address specified by the customer. Customers bear the risk of loss or theft of products after they have been delivered.
Image Copyrights
Any image bearing the Marine Fiberglass Direct logo watermark may be used only for Marine Fiberglass Direct accounts, including our eBay and Amazon listings and our website at www.marinefiberglassdirect.com. Our permission is required if you are not an employee or owner of Marine Fiberglass Direct. If you use our images outside of our permissions, we will contact you or your company with a cease and desist letter by mail; if no mailing address is available, we will send it by email or electronic message. If the terms of that letter are not met, we will take legal action. A penalty of $1,000 applies for each image used without our permission. One cease and desist notice will be sent.
Governing Law / Venue / Jurisdiction
This agreement shall be construed and enforced in accordance with the laws of the state of Florida without regard to the conflicts of law provisions thereof. ALL SALES TRANSACTIONS EXCLUDE THE APPLICATION OF THE 1980 UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALES OF GOODS, IF OTHERWISE APPLICABLE. All claims, actions, disputes, controversies or suits shall be litigated exclusively in the courts of competent jurisdiction in Hillsborough County, Florida, United States. Each party specifically consents to service of process by and the jurisdiction of and venue in those courts and Customer, if not a resident of the United States, hereby appoints the Secretary of State of Florida as its agent for service of process in the United States.
